Baden-Württemberg: Amendment to the state building regulations facilitates the construction of PV systems

On March 13, the Baden-Württemberg state parliament passed the amendment to the state building regulations (LBO). The LBO reform “Faster Construction” now provides for general procedural freedom for photovoltaic systems, “regardless of whether they are system-dependent or system-independent solar energy systems”. The procedural exemption is also extended to (larger) ground-mounted solar energy systems that were previously subject to approval, as building regulations are generally not affected. Insofar as solar energy systems are installed on or in buildings, the associated change to the use or external design of the building remains exempt from the procedure. The amendments also provide for a more comprehensive procedural exemption for charging infrastructure, which also applies to ancillary facilities and existing facilities.
The LBO must now be published in the Official Gazette and will enter into force three months later.
